These are cross revision petitions; one filed by the complainant bearing no.3507/2006 and another filed by the opposite party bearing

no.2717/2006 against the same impugned order passed by the State Commission.  By this common order, we shall dispose of both of them.

          Complainant and his wife joined two chits of value Rs.2,50,000/- each.  Complainant/respondent paid 35 installments in both the chits. As on 29.5.1998, there was accumulation of Rs.1,75,000/- in each of the chits to the credit of the complainant and his wife.  The respondent and his wife could not deposit the 36th and 37th installments payable on June and July, 1998, the petitioner removed the complainant and his wife from the said chits for non-payment of chits installments.  Thus, being aggrieved, respondent file the complaint before the District Forum.

          District Forum allowed the complaint and held the opposite parties no.1 and 2 i.e. the petitioner jointly and severally liable to refund Rs.1,75,000/- in each of the chits with interest @ 12% p.a. from 19.8.1998 till the date of payment along with Rs.5,000/- as compensation and Rs.1,000/- as costs.

          Being aggrieved, petitioner filed the appeal before the State Commission.  The State Commission modified the order of the

District Forum and directed the petitioner to adjust the sum of Rs.3,25,000/- in other chits of the respondent and pay the balance amount with interest @ 9% p.a. to the respondent along with the dividends. 

          It is not disputed before us that in pursuance to the order passed by the District Forum, the petitioner has paid the amounts due as per the order of the State Commission.  Since the order passed by the State Commission stands complied with, we dismiss this revision petition with the observation that the order under revision be not taken as precedent for future reference.
