Final Order / Judgement

Today the case is fixed for passing order.

The complainant files hajira through the Ld. Lawyer.

The case record is taken up for passing order. We have gone through the petition of complaint, documents file by the complainant. It appears from the record that the complainant-company under the name & style ‘’Pave Infrastructure Private Limited’’  is a registered company being corporate identificationNo.U70109WB2009 PTC138874 of 2009-2010 engaged in Civil construction business in North Bengal. It also appears that the complainant runs his business for commercial purpose. Nowhere it is mentioned in his complaint petition that he runs his business for the purposes of earning his livelihood by means of self-employment which is basic requirement to file a consumer complaint. The judgements cited by the Ld. Advocate are also perused, all the cases involved in those judgements relate to commercial purpose for consumers livelihood.

            Thus, the complaint does not fall under the definition of consumer as per C.P Act.

            So, we came to the conclusion that the complaint petition is not maintainable under the purview of the C.P Act.

            Hence, the case rejected.

            Thus the case is disposed of.

            Let a copy of this order be supplied to the complainant free of cost on proper acknowledgement or be sent by registered post in terms of Rule 5(10) of West Bengal Consumer Protection Rules, 1987.
