8.            `3.75 lakh. The insurance policy commenced from 11.01.2010.. The respondent’s husband died on 17.01.2011. The respondent’s claim was rejected through repudiation letter dated 30.04.2011 that her husband was suffering from preexisting health problem at the time of applying for insurance and the conclusion was arrived at, on the basis of the investigator’s report. After the claim was repudiated, the respondent filed that the appellant insurance company subjected her husband to medical examination and having satisfied with his health condition, the appellant had issued the insurance policy. The appellant insurance company refuted the charge stating that basing on information furnished by the respondent’s husband, they have issued the insurance policy.

14.            As such we are inclined to remit the matter to the District Forum giving opportunity to the appellant to file affidavits of the doctor of Government Hospital, Ananthapur. The respondent in the circumstances of the case, can by filing application,
