          This revision petition has been filed with a delay of 170 days which is over and above the statutory period of 90 days given for filing the revision petition.  Under the Consumer Protection Act, 1986 the consumer fora are required to decide the case in a summary manner within 90 days of its filing where no evidence is required to be

taken and within 150 days where the evidence is required to be taken.  In the present case, the delay of 170 days over and above the statutory period given for filing the revision petition, cannot be condoned without showing sufficient cause.  The only reason given for condonation of delay in the application is that after receiving the certified copy of the order on 24.2.2009, the dealing Advocate handed over the certified copy to the Regional Office, Hyderabad on 18.3.2009 where the order received by the concerned department was misplaced with some other files and consequently, this file was inadvertently kept unattended; on receiving the notice under the Execution Petition the file was traced and immediately, the Regional Office sent the file to the Head Office with the opinion to file the Revision Petition before this Hon’ble Commission by letter dated 20.10.2009; accordingly, the Head Office entrusted the matter to the counsel on 28.9.2009.

          Very often, such types of pleas are taken.  The                     explanation given is stereo type explanation and such type                                  of  explanations  are  unacceptable.  We  are  not  satisfied  with

the cause shown.  Application for condonation of delay is dismissed.  Consequently, revision petition is dismissed as barred by time.
