          Complainant filed a petition under Section 35 read with Section 37 and 38 of the C.P. Act, 2019 praying for an order of temporary injunction restraining the O.Ps / Developers from obstructing the complainant from his entrance in the schedule property and in the garage which is described in the ‘B-1’ and ‘B-2’ schedule property stating the ground therein inter-alia. The instant petition is registered as M.A. case being No. 01/2021. The petition is moved. Heard. Perused the complaint, the instant petition as well as the supporting documents. On perusal aforesaid materials it is appeared to us that though prima-facie case is made out but we found no irreparable loss on part of the complainant which does not bear any urgency. Rather if the O.Ps be injuncted in that event the balance of inconvenience will create in future in disposing the instant case since the trial of the case under C.P. Act, 2019 is a summary procedure which ought to be disposed within 90 days. In case of violation of any injunction order delay will surely be created. Considering such legal position it is unwise to allow this petition. Hence the instant M.A being No. 01/2021 is dismissed.

 

            Todate (20.04.2021).

             

Hence for ends of Justice it is

Ordered

            that the instant M.A. being No.01/2021 is dismissed.

 

            Let the plain copy of this order be supplied to the parties free of cost as per the provision of the CPR, 2005.
