                                                ORDER

                   This appeal has been filed by appellants/OPs (hereinafter referred as appellants) against the impugned order dated 28.01.2016 passed in CC No.154 of 2015 by the District Consumer Disputes Redressal Forum,  Sahibzada Ajit Singh Nagar Mohali, (hereinafter in short (District Forum), vide which the complaint filed by the complainant was allowed with the following directions to  the OPs:-

  1. To refund to the complainant Rs.67,416/- AUD 710 and Rs.39,326/- along with interest thereon @ 9% per annum w.e.f 22.05.2014, 03.06.2014 and 06.06.2014 respectively till actual payment.
  2. To pay to the complainant a lump sum compensation of Rs.25,000/- (Rs.twenty five thousand only) for mental agony, harassment and costs of litigation.

 

2.                Against this order OPs filed this appeal. However, during the pendency of the appeal the matter was compromised between the parties. Counsel for the appellant made a statement before this Commission on 30.11.2016 stating that the matter has been settled to pay Rs.1,00,000/- to the respondent/complainant out of which Rs.85,000/- along with interest deposited with this Commission at the time of filing the appeal and that amount be paid to the complainant along with interest and a cheque No.414984 amounting to Rs.15,000/- has been paid to the complainant.

3.                The complainant which is present in person along with his advocate Sh. Sukhjit Singh, Advocate accepted that compromise and have settled the matter for a sum of Rs.1,00,000/-. She further made a statement that a sum of Rs.85,000/- along with interest  deposited with this Commission at the time of filing the appeal be released in her favour. She has further received a cheque No.414984 amounting to Rs.15,000/-. However, this compromise will be subject to encashment of the cheque. In case the cheque is not encashed then she will be free to get this amount be way of execution application.   

4.                In view of the above compromise the order of the District Forum is ordered to be modified as under:-  “In view of the statement given by the counsel for the appellant and the respondent along with his counsel the complaint filed by the complainant has been settled with OP for a sum of Rs.1,00,000/- under which the complainant is entitled to Rs.85,000/- deposited by OP with this Commission at the time of filing the appeal along with interest. Therefore, registry is directed to release this amount forthwith in favour of the respondent/complainant. The complainant has further received a cheque No.414984 amounting to Rs.15,000/-. In case the cheque is not encashed then the complainant will be at liberty to get that amount by way of execution from the OPs. Accordingly, the appeal may be disposed of as compromise.
