Final Order / Judgement

Learned counsel for the revision petitioner is present.

In this revision petition, revision petitioner has made prayer to set aside the ex parte interim order dated 4.6.2019 passed by the learned District Forum, Sundargarh – II at Rourkela in Misc. Case No. 42 of 2019 arising out of CC No. 71 of 2019.

Revision petitioner Financer is the OP whereas the OP in this revision petition is the complainant before the learned District Forum.

It is submitted by the learned counsel for the revision petitioner that though the learned District Forum has observed in the impugned order that outstanding arrear against the complainant is Rs.3,86,346/- by the ex parte interim order the Financer has been directed to release the repossessed vehicle upon  receipt of Rs.2.00 lacs only from the complainant.

On perusal of the impugned order, it is found that the revision petitioner has been directed to file objection to the interim application on 9.7.2019. Instead of filing objection, the revision petitioner has rushed to this Commission.

In the above circumstances, the revision petition is disposed of directing the revision petitioner to file objection to the interim application upon which the learned District Forum shall proceed to hear the objection and dispose of the interim application on merit after giving opportunity to the parties by 15.7.2019.

The impugned ex parte interim order shall be kept in abeyance till disposal of the interim application.
