The impugned order allowing the complaint claiming of Rs. 50,000/- as accidental benefit with compensation of Rs. 5,000/-, is under challenge.

The complainant’s father lonee under Kisan Credit Card, Scheme claimed accidental benefit under PNB KCC scheme for a sum of Rs. 50,000/- on account of accidental death of his son, under the above scheme Bank denied the claim on the ground that loan account was irregular. The complainant did not inform the Bank and did not lodge claim within 30 day of the death as required under the statutory scheme for death of her son on 03.01.2012, even though he made same deposits on 2.03.2012 in the account.
3. The District Forum considering documents on the record specially the scheme in question allowed the complaint as per the impugned order.
4. Appellant and the Respondent both filed written notes of argument in support of their respective cases and also certain decisions.
5. We have considered the case of the parties, perused the impugned order and the decisions brought on record. It is not in dispute that the claim and its deniad rests on the terms of the scheme . The scheme no doubt allow accidental benefit however the scheme mandates that the claim has to be lodged within 30 days of the death in the prescribed format along with death certificate from the attending doctor / Hospital. Report of claims enquiry –cum- verification committee on receiving the information regarding accidental death within stipulated period. No claim could be paid on non complying the requirements under the scheme. Admittedly complainant did not to the same.
5. The District Forum has not considered these aspect of matter and allowed the complaint.
6. The impugned order cannot be sustained in law, it is thus set aside.
7. In the result stands allowed.
