               Sibasis Sarkar, Ld.President :– The application filed by the O.Ps.praying for vacating the order passed by this Forum for hearing the case exparte is taken up for hearing. Perused the application and other materials on record. Heard both sides.

 

               It appears from the record that the notice upon the O.Ps. was duly served, but the O.Ps.did not turn up. As such the case has been posted for exparte hearing today. We also find that there is no inordinate delay in filing the Written Version. So for giving the O.Ps. an opportunity to contest the case, the application should be allowed with cost. Accordingly the application is considered and allowed with a cost of Rs.1,000/- to be deposited in the Consumer Legal Aid Fund, DCDRF,Paschim Medinipur. The Written Version will be accepted subject to payment of cost.

                                

                                             Hence, it is

                                                             ORDERED

             that the Misc.Application No. 56/18 dt.-14.9.18 be and the same is allowed on contest. The order dated-03.8.2018 for hearing the case exparte  is hereby vacated with a cost of Rs.1,000/-. The W.V. filed by the O.Ps. will be accepted only after payment of cost. That the Misc.Application is thus disposed of.  

Let a plain copy of this order be given to the parties free of cost.
