1. The present miscellaneous application has been filed on behalf of applicant/complainant for release of the amount of Rs.2,53,935/- alongwith interest, if any to the complainant. It is averred in the application that on 08.06.2023, OPs deposited part payment of Rs.2,53,935/- with this Commission and for compliance of the order dated 24.08.2018 passed by this Commission, complainant is entitled for the amount deposited by the OPs and prayed for release of the aforesaid amount. The application is supported with affidavit. 2. Reply to the application not filed by non-applicant/OPs which makes it clear that the OPs do not want to resist the application. 3. A perusal of the zimni order dated 08.06.2023 passed by this Commission in EA/61/2022 indicates that counsel for JDs had tendered demand draft for an amount of Rs.2,53,935/- bearing draft No.750439 dated 30.05.2023 drawn on State Bank of India in favour of President DCDRC-I Chandigarh towards compliance of the order under execution and this draft has been deposited in the official account of this Commission. 4. In view of the above, the application in hand stands allowed. It is ordered that the amount of Rs.2,53,935/-, lying deposited with this Commission in this case, alongwith accrued interest thereon be released in favour of applicant/complainant Sukhdev Kaur through NEFT/RTGS, on furnishing bank account details by the applicant/complainant, against proper receipt & identification. Office to take necessary action for release of the amount. Office should ensure the correctness of the bank account details of the complainant before getting the amount transferred in her account. The present miscellaneous application is disposed of accordingly. It be tagged with the execution application file No.61 of 2022. 5. Certified copies of this order be sent to the parties free of cost. |
