File taken up today before the National Lok Adalat.
2. As observed on the previous date of hearing that as per Judgment Debtors-opposite parties they have already complied with the award under execution and they have already paid up the entire amount nothing is outstanding to be paid to the Decree Holder-complainant and even they have already furnished the TDS certificate in favour of the Decree Holders-complainant. It has also been apparent from the record of this execution application that neither the Decree Holder-complainant in person nor his authorized counsel has been appearing before this Commission from the last so many occasions. This development has also indicated that the award in question has already been complied with. In such a scenario, no useful purpose will be served by keeping this execution pending further. As such, the execution application is hereby dismissed being fully satisfied.
3. Needless to say, that in case, there will be any shortcoming then Decree Holder-complainant will be entitled to file a fresh one.
4. In view of the above-mentioned development, the present execution application stands dismissed being fully satisfied.
5. Let, original documents be returned to the parties after getting photocopies of that documents from them against proper receipt and as per rules, after noting down in the registered, if maintained.
6. A copy of this order be provided to all the parties free of cost as mandated by the Consumer Protection Act, 2019. This order be also uploaded forthwith on the website of the Commission for the perusal of the parties.
7. Application(s), pending, if any, stand disposed off accordingly in terms of this order.
8. File be consigned to record room alongwith a copy of this order.
