Final Order / Judgement

Perused the material available on record. The complainant alleged deficiency of service on the part of the Ops for non release of crop insurance benefit for loss of insured crop during Kharif 2018 and pray for a direction to release insurance benefit of Rs.3,84,903/- along with compensation ;amount of Rs.50,000/- towards mental agony  including litigation cost.

The OP 1 & 3 appeared and filed their written version admitting the fact that the premium of Rs.7698.60 for insurance of paddy crop grown during 2018 has been deducted from the SB Account of the complainant vide No.33869520711 there with the Op 3 and the said premium was remitted to the insurer/OP1 .The Op 1/Insurer has not disputed and receive of the said insurance premium vide application No.040121181180731928901 for sum assured amount of Rs.3,84,903/- against the paddy crop grown  over 5.640 decimal of agriculture land  of the complainant situated in village Bagbahal under Borguda G.P of Golamunda PS Dist. Kalahandi is also not disputed. However, it is submitted that, the actual yield during Kharif 2021 was 2047 i.e. higher than the threshold yield of 1945 and there was no loss suffered by the complainant and thus  as per the term and condition of the PMFBY the complainant is not entitle to get any crop insurance benefit. So also he is not entitle for any relief claimed.

On perusal of the report submitted by OP 2/Chief District Agriculture Officer vide letter No.5184 dt.20.03.204 it is found that, during Kharif 2018 Borguda GP of Golamunda was declared  no shortfall  in yield  of paddy crop  which clearly prove that complainant is not entitle for crop insurance benefit under PMFBY during Kharif 2018. No cogent evidence is adduced by the complainant to hold any deficiency of service on the part of the Ops. Hence, this complaint has got no merit and liable to  be dismissed.

Accordingly complaint is dismissed on merit against the Ops on contest. No order as to cost. Complaint is disposed of accordingly.
