By Sri.M.S.Sasidharan, Member: The complaint is filed to get back the amount deposited in the respondent firm with interest. The complainant deposited Rs.25,000/- on 11/3/2003. It was assured to return the amount with 12% interest after one year. When the complainant demanded the amount on the due date the respondents wanted some time to return the amount and the interest up to 10/3/2004 was given. Later it was realized that the respondent left the place with the money deposited after closing the firm. The complainant is entitled to get back Rs.25,000/- with interest.. Hence the complaint. 2. The respondent is called absent and declared exparte. 3. The complainant has filed affidavit and produced the deposit receipt to prove the case. It is marked as Exhibit P1. 4. The case of the complainant is that he had deposited Rs.25,000/- in the respondent’s firm as per Exhibit P1 receipt. It was promised to return the amount with 12% interest. But it was not done. The interest as promised was given for one year. But later the respondent closed the firm and left the place. The complainant is entitled to get Rs.25,000/- with interest. . There is no evidence to the contrary. 5. In the result, the complaint is allowed and the respondent is directed to return the Ext. P1 amount with interest at the rate of 9% per annum from 11/3/2004 till realization with cost Rs.1,000/- (Rupees One thousand only) within two months from the date of receipt of copy of this order.
