By Smt. Padmini Sudheesh, President:

The complaint is filed to get back the amount deposited in the respondent firm along with interest. The case is that the complainant deposited Rs.10,000/- on 8/10/2001 and it was assured to return the amount with 12% interest after one year. When the complainant demanded the amount on the due date the respondent wanted some time to return the amount and the interest up to 8/2/2004 was given. Later it was realized on enquiry that the respondent left the place with the money deposited after closing the firm. The complainant is entitled to get back Rs.10,000/- with interest.. Hence the complaint.

            2. The respondent called absent and declared exparte.

            3. The complainant has filed affidavit and produced the deposit receipt to prove the case.   It is marked as Exhibit P1.

            4. The case of the complainant is that he deposited Rs.10,000/- in the respondent’s firm as per Exhibit P1 receipt.    It was promised to give back the amount with 12% interest on the due date. But when requested the respondent demanded some more time to return the amount. The interest as promised was given for one year. But later the respondent closed the firm and left the place. The complainant is entitled to get Rs.10,000/- with interest.    There is no other evidence to the contrary.

            5. In the result, the complaint is allowed and the respondent is directed to return the Ext. P1 amount with 9% interest from 8.2.2004 till realization with cost Rs.1,000/- (Rupees One thousand only)within two months.
