By Sri.M.S.Sasidharan, Member: The complaint is filed to get back the amount deposited in the respondent firm with interest. The case is that the complainant deposited Rs.20,000/- on 9/7/2001 and was assured to return the amount with 12% interest after one year. When the complainant demanded the amount it was not returned. Later it was realized that the respondent left the place with the money deposited after closing the firm. This is deficiency in service. The complainant is entitled to get back Rs.20,000/- with interest.. Hence the complaint. 2. The respondent is called absent and declared exparte. 3. The complainant filed affidavit and produced the deposit receipt to prove the case. It is marked as Exhibit P1. 4. The case of the complainant is that he deposited Rs.20,000/- in the respondent’s firm as per Exhibit P1 receipt. It was promised to give back the amount with 12% interest on the due date. But when requested the respondent failed to return the money. Later it was realized that the respondent had closed the firm and left the place. The complainant is entitled to get Rs.20,000/- with interest. There is no evidence to the contrary. 5. In the result, the complaint is allowed and the respondent is directed to return Ext. P1 amount with interest at the rate of 9% per annum from 9/7/2001 till realization with cost Rs.1,000/- (Rupees One thousand only) within two months.
