The complainant’s case is as follows: The complainant has deposited Rs.6000/- by 12 instalments at Rs.500/- each in the Royal Investment Scheme conducted by the respondent.   The deposit was made in favour of the minor son. Later on enquiry it was realized that the respondent firm was closed and the amount invested has not been returned. Hence the complaint.

            2. The respondent called absent and declared exparte.

            3. The complainant has filed affidavit and produced the card wherein the instalments remitted have been recorded. It is marked as Ext. P1.

            4. The definite case of the complainant is that he has remitted Rs.6000/- by 12 instalments at Rs.500/- each in the Royal Investment scheme conducted by the respondent. The respondent firm was closed and further instalments could not be continued. The respondent absconded with the money deposited by the depositors after closing the firm. The complainant is entitled to get back Rs.6000/- with 12% interest from 25.2.2004. All the 12 remittances were recorded in the Ext. P1 card. There is no other evidence contradictory to the evidence produced by the complainant.

            5. In the result, the complaint is allowed and the respondent is directed to return the Ext. P1 amount with 9% interest from 25.2.2004 till realization with cost Rs.500/- within two months.
