Complainant called out absent. On perusal of the order sheet dated 20.07.2022 it was observed that the complainant called out absent.  Counsel for OP Nos.2 and 3 was present. On perusal of the order sheet, it is noticed that this case was posted on 05.08.2019 for filing affidavit of complainant since then till today more than 3 years, the complainant remained absent and not shown interest to file affidavit of complainant.  However considering the nature of the complaint, on payment of cost of Rs.1,500/- this case is adjourned to this day for filing affidavit of complainant as last and final chance.  Even then, complainant not present and not filed affidavit.  It shows that the complainant is not interest to proceed against the OP. Therefore, the non-filing of affidavit of complainant in support of his case, there is no case.  Hence, the complainant of the complaint is dismissed for default as well as non-prosecution.
