ORDER

During the course of hearing Mr. N. Balakrishnan A/R of the

petitioner has referred to a communication dated 12.02.2014 whereby the Central Board of Secondary Education appears to have directed the Manager of the respondent school to reimburse the fee, if due, as per rule Chapter II (11) of the Affiliation Bye-laws of the Board, under intimation to them.

               Since the said communication was issued much after the orders made by the District Forum as also the State Commission, it would not be proper for us to rely upon the said documents for adjudication on the question raised in the petition, as the said document was not before the lower fora.

               At this juncture, Mr. Balakrishnan seeks leave to withdraw this Revision Petition with liberty to approach the School for reimbursement of the fees in terms of aforenoted communication.  Accordingly, we dismiss the Revision Petition as not pressed with liberty as prayed.  It goes without saying that if the petitioner applies to the school for reimbursement of the fee, his request shall be considered strictly in accordance with the direction issued in the afore noted communication.  In the event of the petitioner not

fully satisfied with the decision of the school, it will be open to him to seek redressal of his grievance in accordance with law, including approaching the Central Board of Secondary Education for appropriate directions.
