ORDER
SRI.P.V. JAYARAJAN, PRESIDENT:
This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:
This is a case filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. The 1st opposite party after receiving the notice from this Commission not appeared before this Commission on the date fixed for the same and hence opposite party No.1 was declared ex parte. Opposite party No.2 filed version denying the allegation raised by the complainant against the opposite party. As the complainant was continuously absent since 11/07/2019, this Commission issued a notice to the complainant to appear before this Commission on 14/03/2022. Today when the case was came up for hearing the complainant was absent, even after accepting the notice from this Commission. The complainant has not filed affidavit or marked documents to establish his case. Hence we find that the complainant is miserably failed to establish his case put forward against the opposite parties. In view of the continuous absence of the complainant we find that the complainant is not interested to further proceed with this complaint. In the above circumstances we find that this is a fit case to be dismissed for default.
In the result the complaint is dismissed. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
