Roy Varghese, Karikkottil House, Mekkadampu P.O, -- RESPONDENT Kadathykara, Velloorkunnam village, Muvattupuzha Taluk. ORDER JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT The revision petitioners are the opposite parties in CC.482/08 in the file of CDRF, Ernakulam. The matter sought to be revised is the order of the Forum rejecting the contentions that only the Consumer Disputes Redressal Forum, South Mumbai is having jurisdiction in the matter. The Forum in the order has noted that the terms and conditions could not be ascertained with naked eyes. 2. The revision petitioner has also submitted a copy of the above terms and conditions. We find that it is in very small print. Evidently, the complainant was made to sign on the dotted line. We find that the above practice cannot be countenanced. Except by a specific agreement the jurisdiction cannot be out ousted. We find that there is no scope for admitting the revision petition. 3. In the result, the revision petition is dismissed in limine. The office will forward a copy of this order to the Forum urgently. JUSTICE K.R.UDAYABHANU -- PRESIDENT |
