Order No.09, Dated: 26.04.2017
The complainants are absent on calls. Today is fixed for show cause by the complainants as to why the case shall not be dismissed for default for non-taking steps for service of notices upon the O.Ps. No objection is forthcoming from the end of the complainants that steps have been taken by them for issuance of notices upon the O.ps. On the earlier date i.e. 4.4.2017 by filing a petition prayer was made by the complainants to fix another date for taking steps for service of notices upon the O.ps. But the record shows that more or less four dates were given to the complainants, but to no effect. On the whole it was observed by this Ld. Forum that ground mentioned in the petition dated 4.4.2017 could not be accepted and accordingly the same was rejected. Under this circumstances, as the complainants are absent on calls today in our view the complainants have lost their energy and faith towards this complaint. As per C.P. Act, if the evidence is adduced on the said complaint then the complaint might have been disposed of on merit. But in the instant complaint picture is otherwise i.e. no evidence has been adduced by t he complainants. Hence, we have no option but to dismiss the complaint for default. Hence, it is
Ordered
that the C.C. being No.219/2016 is hereby dismissed for default.
Let the copies of this order be supplied to the parties free of cost.
