J U D G E M E N T
Bibekananda Pramanik, President – This consumer complaint under section 12 of the C.P. Act, 1986 has been filed by the complainant Smt. Sikha Rani Jana against the above named O.ps. alleging deficiency in service on the part of the O.ps.
Complainant’s case, in brief, is as follows :-
Being approached by the agent of the O.ps. the complainant on different dates stating from 07/12/2012 to 15/01/2015 invested Rs.15,00,000/- in M.I.S. scheme of the O.ps., the details of which has been mentioned in paragraph “5” of the petition of complaint. It is stated that in regard to such investment, the O.ps. have paid interest to the complainant upto the month of April, 2015 the particulars of which has been mentioned in paragraph “6” of petition of complaint. Thereafter since the month of May, 2015 the O.ps. have not paid any M.I.S. amount to the complainant in spite of several requests. Hence the complaint praying for directing the O.ps. to pay Rs.18,75,000/- to the complainant towards the principal amount of M.I.S. and interest thereof and for an order of compensation of Rs.50,000/- and litigation cost of Rs.10,000/-.
After receipt of notice of this case, O.ps. appeared in this case and filed a joint w.v. Thereafter on the date of filing questionnaire on 24.01.2019, the O.ps. did not appear for which the case was ordered to be proceeded ex-parte against the O.ps. Hence the ex-parte hearing.

Is the complainant entitled to get the reliefs, as prayed for?
DECISION WITH REASONS
To prove her case, the complainant Smt. Sikha Rani Jana filed a petition supported by affidavit praying for treating her petition of complaint as evidence. She has also filed some documents in support of her case. We have gone through the petition of complainant supported by affidavit which has been treated as evidence and the documents filed by the complainant.
Considering the case made out in the petition of complaint supported by affidavit and the documents filed by the complainant, remaining un-challenged, it is held that the complainant’s case is proved and she is entitled to get the reliefs, as prayed for.
Hence,
it is,
O R D E R E D
that the complaint case no. 425/2017 is allowed ex-parte with cost against the O.ps. O.ps. are directed to pay Rs.18,75,000/- to the complainant and they are further directed to pay Rs.20,000/- as compensation and Rs.5,000/- as litigation cost to the complainant.
All such payment shall be made within 2(two) months for this date of order.
Let a plain copy of this order be given to the complainant free of cost.
