          The petitioner/complainant, Shri Vijay Kumar applied for release of new gas connection with the Roop Gas Agency, HP Gas, SCO 266, IInd floor, Sector 20, Panchkula.  He was allotted token No. B-4675.  Thereafter, the complainant was again re-allotted token No. B-481.  He was asked to wait for sometime.  However, the gas cylinder was not released in his favour.  The case of the petitioner is that he has deposited a cheque in the sum of Rs.4550/- but there is no evidence that he had deposited any fees, dues, security with the opposite party by applying the gas connection.  He could not produce any receipt duly signed by the dealer/opposite party or his authorized agent to be issued to the customer as token for applying new gas connection.  There is nothing on record to show that the petitioner had availed the services of opposite party on payment of any consideration.  No gas connection was, however, allotted to him.  He has also not given the names of those persons who had applied subsequently and were allotted gas connection earlier to him.

            Since the gas connection was never allotted to the petitioner, he is not entitled to the relief claimed by him.  He does not qualify to be a ‘consumer’ in this case.  Dismissed.
