Complainant called. Absent.  The complainant on 12-02-2014 appeared inperson and filed joint memo.  The complainant on 12-02-2014 endorsed on the complaint that the matter was settled out of Forum.  In the joint memo filed by both parties the following was mentioned: 

“I filed above complaint against the above Opposite parties for replacement of defective mobile phone.  In this regard the above opposite parties have given new mobile phone with new extra features A118 model today.  I accepted to take the mobile phone towards F&F settlement of the CC No.01/2014.  Therefore I request CC No.1/2014 may be dismissed without costs as this matter is settled out of Court”. 

In view of the said endorsement and joint memo the complaint is dismissed as settled.  No costs. 

This, the 10^th day of February, 2014.
