Heard learned counsel for the petitioner. According to him learned District Commission passed the order to release the vehicle on certain conditions but impugned  order is like the order of allowing complaint in final disposal. Secondly learned counsel for the petitioner  submitted that learned Arbitration  has passed the order to repossess the vehicle U/S-17 of the Arbitration and Conciliation Act on 06.11.2022. But learned District Commission passed the order to release the vehicle  on 05.12.2022. So, he submitted to set-aside the order.

                        Considered the submissions, perused the documents and impugned order.  At the stage of admission, we find  it appropriate  for disposal  of the revision petition on the contention of learned counsel for the petitioner. The entire impugned order  has been passed purportedly  U/S-38 of the Act. Upon perusal of impugned order,  we are not inclined to interfere with the  same. However, learned counsel for the petitioner is directed to place all the submissions before the learned District Commission and learned District Commission would consider to  pass a speaking order within a period of 30 days from the date of receipt of this order. Learned counsel for the petitioner is directed to place the copy of the order before the learned District Commission on 13.02.2023 to take further instruction.

            The Revision petition is disposed of accordingly.
