Case called out.  It is 2:50 p.m.

Neither the appellant nor its counsel is present.

This appeal was preferred with a delay of 79 days’ before this Commission.

As this Commission, at the time of issuing notice on delay condonation application, directed the appellant to take steps for respondents.

However, the first notice sent to the respondents has been received back with an endorsement that the respondents have left the address mentioned on the envelope.  Therefore, this Commission again on 20.01.2015 directed the appellant to take steps for respondents during course of the day. The appellant took steps, but the notices sent to the respondents again received back with an endorsement that the respondents left the address. Thereafter, the appellant is again directed to take fresh steps on the correct address within a week. 

Today, neither the appellant nor its counsel is present, nor the steps have been taken in compliance of the order passed by this Commission till today.

As none is present on behalf of the appellant to press the delay condonation application as well as affidavit, hence, the delay condonation application is dismissed in default of the appellant, consequently the appeal also stands dismissed for want of prosecution as well as in default of the appellant.

Stay order dated 25.06.2014 stands vacated.
