JUDGMENT

  1. The present complaint has been filed by the complainant before this commission for  the following reliefs-
  1. The Op be directed to pay the cost of the smart card Rs.1050/
  2. Compensation for economic and mental agony Rs.103050/ be awared.
  3. Cost of the case.
  1. Complainant has stated that she applied for issuing the RFID Smart card on 27.5.2016 at the booking office of the Masudabad Bus Stand Aligarh. Complainant visited the booking office to get the smart card but the employee of the booking center avoided to give the smart card. Complainant sent a notice dated 10.9.2016 but neither the smart card was  given no its price Rs.1050/ was repaid. Complainant has suffered loss of Rs.2000/ cost of notice, Rs.1050/ as price of the smart card and Rs. 100000/ again mental agony and economic suffering.
  2.  OP  stated in WS that the complainant had applied for open indent card on 27.05.2016 the amount Rs.1050/ receipt no.113489. the registration no of the application for issuing card was ALGAL 160113489. Complainant’s representative had received the card at Masoodabad Bus Stand on 15.07.2016. It was entered in the counter registrar and there are signature of the representative and his mobile Number the certified copy of the register and status report of smart card have been filed..
  3.  Complainant has filed his affidavit and papers in support of his pleadings. And Op has also filed his affidavit and papers in support of his pleadings.
  4. We have perused the material available on record and heard the parties counsel.
  5. The first question of consideration before us is whether the complainant is entitled to any relief?  
  6. It is evident from the record that the op has filed the attested copy of card status receipt and counter receipt which shows that as per card status card was delivered to complainant and copy of receipt is on the record in which contains the remarks as please handover this receipt while collection of your card. It means that the card was given on producing this receipt. This also attested copy of couter register which shows that on 15.7.2016 at serial no.96 the name of complainant is entered. There is sufficient proof of giving the card to the complainant and there is no substance in the complaint and is liable to dismiss.    
  7. The question formulated above is decided against the complainant.
  8. We hereby dismiss the complaint.
  9. A copy of this judgment be provided to all the parties as per rule as mandated by Consumer Protection Act, 2019. The judgment be uploaded forthwith on the website of the commission for the perusal of the parties.
  10. File be consigned to record room along with a copy of this judgment.
