O R D E R

1.   Pleadings of the complainant in brief

      The complainants entered into an employment agreement with ‘BIGWAY’ Canada through the opposite parties on 16/04/2021 on the assurance that employment shall be provided to them with a salary of $ 38,400 per year to each besides re-imbursement of the expenses incurred.  The complainants remitted a sum of Rs. 76,000/- as visa processing charge through UPI transaction.  This amount covers the registration charge, visa processing fees, visa processing charge, etc. and other charges will be deducted from the candidate’s salary.  Inspite of spending this amount, they did not get any job as assured.  The complainant suffered great mental agony and financial loss due to the deficiency in service on the part of opposite parties.

          So they filed this complaint for getting an order

  1. To direct the opposite parties to pay Rs. 76,000/- with 12% from 16/04/2021 till realization.
  2. To pay Rs. 25,000/- as compensation for the mental agony and loss suffered by the complainants.
  3. To award the cost of the proceedings and such other reliefs as the Commission finds fit & proper to grant.

 

2.   After admitting complaint, notices were issued to the opposite parties.  Notices issued to the opposite parties returned with endorsement ‘No such person in the Address’.  Later the complainant produced e-mail id of opposite parties and e-mails were served on the opposite parties.  But they did not appear or file their version.  So they were set ex-parte.

     

3.   The complainants were continuously absent for the postings on 16/01/2023, 20/02/2023 and 24/03/2023.  Since the complainants were continuously absent for the proceedings before the Commission, it appears that they are not interested in proceeding with the complaint. 

      Hence the complaint is dismissed.
