Advocate for the complainant in order to consider matter of admission of the instant case we have gone through the petition of the complainant and photo copies of the documents which are filed from complainant side. On going through the petition of complainant it palpably appears that complainant purchased one Air Conditioner from ‘Great Eastern’ at Suri on 18/05/2019 and accordingly the complaint is a Consumer of ‘Great Eastern’ and not of the Ritam Enterprise who is OP No. 1 while OP No. 2 ‘Bajaj Finance Ltd’, but from the produced documents of banks statements it appears the name of ‘Bajaj Auto’ not of Bajaj Finance Ltd, OP No. 2. No other document paper relating to this opposite parties on record is found or produced. Under the circumstance we are of the considered view that complainant is not a prima facie Consumer as per definition of the term ‘Consumer’ as embodied is C.P Act, 1986 and on this back drop due to lack of prima facie case this instant case has no legs to stand and accordingly not admitted.
