Ld. Counsel appearing for the Revisionist/Petitioner is present.

Being aggrieved and dissatisfied with Order No.04 dated 02.09.2022 passed by the DCDRC, Nadia passing order to the effect the case was proceeded ex-parte against Opposite Party No.2 and fixing 07.09.2022 for filing W/V by Opposite Party No.3 as last chance.

Ld. Counsel for the Revisionist/Petitioner submitted that there was a miscommunication.  So, she could not take steps before the Ld. Commission below.  She prayed for appropriate order.

Prayer is considered and allowed.

Considering the facts and circumstances the Revision Petition is allowed subject to payment of cost of Rs.1000/- (Rupees One thousand only) payable to the Complainant concerned.

Fix 18.12.2024 for appearance of the parties and payment of the cost.

Ld. Commission below is requested to dispose of the case in accordance with law and giving an opportunity for filing W/V by the Revisionist/Petitioner after payment of the cost.

Let a copy of this order be sent to the Ld. Commission below.

The impugned order is modified accordingly.

Thus, the Revision Petition is allowed and disposed of.
