ORDER    

                   Brief facts of the present complaint are that the complainant had purchased two CCTV Cameras bearing Sr.No.5DC8B028PA509952 from OP for a sum of Rs.11750/- vide bill No.338 dated 02.08.2019. The cameras were installed by the Op at the house of the complainant.  The product in question was having two years guarantee but the cameras stopped working during the guarantee period. The complainant lodged a complaint with the Op, on this, the Op visited the house of the complainant and took some articles such as DVR CP Plus and HDO1 TBWD with him.  The complainant again went to the Op and requested for repairing the CCTV cameras but the Op refused to do so.    The act and conduct of the Op clearly amounts to deficiency in service on its part. Hence, this complaint.

2.                          On notice, none has appeared before this Commission, therefore, it was proceeded against ex-parte vide order dated 11.09.2020.

3.                In evidence, the complainant has tendered affidavit Annexure CW1/A and document Annexure C1.

4.                It is established on the case file that the complainant had purchased CCTV cameras from the Op vide bill Annexure C1. The grievance of the complainant is that the CCTV cameras stopped working during the guarantee period but the Op has neither repaired the same nor replaced it with new one and even it has taken away some parts of  the cameras with it. In support of his version the complainant has filed his duly sworn affidavit Annexure C1 on the case file. It is also established on the case file that the cameras were having guarantee of two years and it went out of order within the guarantee period. It is proved on the case file that the Op has failed to redress the grievance of the complainant during guarantee period. It is worthwhile to mention here that the preamble of the Consumer Protection Act is to protect the consumers from the deficiency and unfair trade practice of the seller. The pleadings and contentions put forth by the complainant remained unrebutted as the Op did not join the proceedings of the case and opted to remain exparte.   

6.                Keeping in view all the facts and circumstances mentioned above, we allow this complaint and direct the opposite party to refund the amount of Rs.11715/-, as mentioned in bill Annexure C1, to the complainant subject to returning of the camera and its allied articles lying in the house of the complainant, to the OP within a period of 15 days.  Order of this Commission be complied within a period of 30 days from the date of receipt of copy of this order failing which the awarded amount would carry interest @ 9 % per annum from the date of filing of the complaint till its realization. Copy of this order be supplied to both the parties free of cost.  File be consigned after due compliance.
