Final Order / Judgement | After hearing the Complainant in person it is found that this is a case for direction to OP No.2 & 3 for refund of Rs.63,018/- and also for compensation. It is the case of the Complainant that he approached Richfeel Teratology Center for his hair treatment and procured a loan for the aforesaid treatment from OP No.3 i.e. Bajaj Finserv Salt Lake, Kolkata. The Complainant now wants to say that the said loan was sanctioned without his consent. But it is his admission that the OTP generated at the time on his cell phone was used to obtain the loan. Therefore, it stands to reason that with his concurrence the loan was sanctioned. When loan was taken by him and when he allowed the financer to collect the EMI from bank account then it becomes clear that there was a out and out loan transaction and the said transaction is still on. There is hardly any case of deficiency of service or defective goods or unfair trade practice. Therefore, the case of the Complainant for refund of the entire amount and for compensation has no leg to stand upon and the complaint stands dismissed.
