ORDER :- (Per Shri P.N.Kashalkar, Hon’ble Presiding Judicial Member)

(1)          Adv.A.S.Vidyarthi for the applicant/appellant and Mr.Rajan Alimchandani appears in person for her daughter, who is non-applicant/respondent.  He is directed to produce authority letter on next date.  When we asked Mr.Rajan Alimchandani about application for condonation of delay presented by the Appellant, he said that the said application should not be allowed.

(2)               There is a delay of 28 days in filing the appeal.  Hence, the application for condonation of delay is made and affidavit in support thereof has been sworn.  Delay is tried to be explained in Para 4 & 6 of the application for delay condonation on the ground that the impugned order was put up for approval of the higher authorities of the appellant for filing the appeal.  Reasons mentioned the application to condone the delay are just and proper.  We, therefore, are inclined to condone the delay subject to payment of certain cost.  Holding accordingly, we pass the following order.  

ORDER

(1)     The application for condonation of delay is allowed subject to cost of `2,000/- to be payable by applicant/appellant to non-applicant/respondent.
