This petition filed by the complainant U/s. 35 of C.P.Act, 2019.
2. The case of the complainant is that on 6.2.2016 the complaint deposited an amount of Rs. 82,000.00 each in Accounts No. 22236403318, 22236403319, 22236403320, 22236403321 & 22236403322. On the same day he has deposited an amount of Rs. 85,630.00 in account No. 22236403323, Rs.83,000.00 in account No. 22236403324,22236403325 & 22236403326 .Those accounts were to be matured on 06.02.2020 & 06.02.2019 .Although the complainant approached the opp.parties in several occasions they did not pay the matured amount to the complainant. The introducer -opp.party No.3 falsely assured for refund of the maturity amount by the opp.parties to the complainant. As the opp.parties did not pay the maturated amount, on 15.11.2020 , the complainant sent a pleader notice to all the opp.parties through Regd. Post with A.D for payment of the dues, for which the complainant is entitled for. In response to such notice the opp.party No.2 has sent a letter to the advocate of the complainant on 19.12.2020 but the maturity amount was not paid to the complainant. On the other hand the opp.party No.2 informed the complainant that they are trying to pay the matured amount as soon as possible which depends upon the funds provided by their company. Hence this case for maturity amount along with interest, compensation for deficiency in service , unfair trade practice ,litigation cost and other reliefs.
3. Notices were issued to all the opp.parties through Regd. Post with A.D .From the A.D in respect of opp.party No.2 it appears that he has received the summon from this Commission on 03.03.2021. The A.D in respect of opp.party No.1 & 3 are not available in the case record. However as the notices were issued to the opp.parties through Regd. Post with A.D in correct address, it is deemed that notice has been duly served on opp.party No.1 & 3 . Inspite of notice served on the opp.party ,they did not prefer to file their written version/show cause. Only on 17.03.2021 the opp.party No.3 appeared through his advocate and filed a petition for time to file show cause. No written statement has been filed by any of the opp.parties. However opp.party No.3 contested the case and opp.party No.1 & 2 are set exparte.
4. The complainant has filed the complaint petition supported with affidavit. During hearing he has filed his affidavit evidence on 01.12.2022. From the complaint petition , affidavit evidence of the complainant it is clear that the complainant has deposited an amount of Rs. 82,000.00 each in Accounts No. 22236403318, 22236403319, 22236403320, 22236403321 & 22236403322, Rs.85,630.00 in account No. 22236403323 and Rs.83,000.00 in account No. 22236403324,22236403325 & 22236403326 which are to be matured on 06.02.2020 & 06.02.2019 and the maturity amount on five numbers of deposits are Rs. 1,45,714.00 each, Rs. Rs.1,52,165.00 in one deposit and Rs. 1,27,488.00 each in three numbers of deposits.
It is clear from the materials on record that the complainant has deposited the aforesaid amount to get the matured amount and the opp.parties have accepted those deposits in course of their business to earn profit. The aforesaid deposits were made by the complainant to earn his livelihood. It is crystal clear from the materials on record that the complainant is entitled to get the matured amount along with interest. Due to non-payment of the dues to the complainant after maturity he sustained loss and subjected him to mental agony. The society of the opp.parties have adopted unfair trade practice.

The case be and same is allowed in part on contest the opp.party No.3 and exparte against the opp.party No.1 & 2. The opp.parties are jointly and severally liable for payment to the complainant. The opp.parties are directed to pay Rs. 12,63,199.00 (Rupees Twelve Thousand Sixty-Three Thousand One Hundred Ninety-Nine) only along with interest @ 12 % p.a from the date of maturity until payment is made. The above opp.parties are also directed to pay an amount of Rs. 15,000.00 (Rupees Fifteen Thousand)only as compensation and Rs.5000.00 (Rupees Five Thousand) only towards litigation expenses. The opp.parties are further directed to comply the order within a period of one month of receipt of this order, failing which they are liable to pay penal interest @ 16% per annum, on the amount to be paid to the complainant.
