This complaint has been filed by the complainant against the opposite parties under section 12 of the Consumer Protection Act 1986 seeking direction  to replace a new mobile of Sony 6802 or to pay the cost of the mobile  phone of Rs.44,500/- and also to pay a sum of Rs.1,00,000/- for causing mental agony and damages and to pay cost of the complaint.

           Proof affidavit of Complainant not filed for long time to prove the averments in the complaint.  Complainant and Counsel called absent for long time. No representation also. Hence the Compliant is   dismissed for default.  No cost.
