R.K.BISHNOI, JUDICIAL MEMBER:

 

          Appellant filed complaint before District Consumer Disputes Redressal Forum, Gurugram (In short “District Forum”) for replacing of the car and other relief as mentioned in the complaint because there was manufacturing defect.

2.      After hearing learned counsel for complainant the same was dismissed vide impugned order dated 04.12.2017 because the vehicle was not in his name.

3.      Feeling aggrieved therefrom, complainant has preferred this appeal.

4.      Arguments heard. File perused.

5.      The vehicle is in the name of VE commercial vehicles limited, whereas the complaint is filed by Mr. Mohit Modgill. As he is not owner of the vehicle he is not having any right to file complaint against respondent because there is no relationship of consumer and service provider in between them.  The findings of learned District Forum are well reasoned based on law and facts and cannot be disturbed.  Resultantly, appeal fails and the same is hereby dismissed in limine.
