Heard on admission and rejected. It is seen that there is no territorial jurisdiction to this Forum to entertain the case. The vehicle was purchased from 2nd respondent which is in Ernakulam. 3rd respondent is made party to file the complaint before this Forum.
2. Petitioner submitted that the defect of tyres is due to the deficiency in service of 3rd respondent. But it is seen not so as per averments in the complaint. As per Section 11(2) of Consumer Protection Act this Forum lacks territorial jurisdiction. Hence the complaint is returned and petitioner is directed to take back the file to approach proper Forum.
