F I N A L O R D E R
1. The instant case was filed by complainant U/S 12 of the C.P. Act, 1986,
as amended against the O.Ps. alleging deficiency in service U/S 2( 1 )( g ), 2( 1 )( o ) of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the O.Ps. to provide registration number of the motor bike from R.T.O., Howrah, tax receipt, insurance, blue book card and other relevant papers for free service and to give guarantee card of the same and for compensation to the tune of Rs. 57,800/- together with other reliefs inasmuch as the O.P. company in spite of delivery of the TVS Star City 110 motor cycle against the purchase money of Rs. 47,800/- did not deliver the registration number and other necessary documents and even the engine chassis number and free service book document. For lack of registration number and other documents the complainant had to face police case U/Ss 129 and 177 of M.V. Act on 30-10-2011.
2. Notices were issued against the o.ps. The o.ps. refused the same. Postal remark or the remark of the deliveryman ‘refused’ tantamounts to goods service and as such the case was heard ex parte.
3. Upon pleadings of both parties two points arose for determination :
i) Is there any deficiency in service on the part of the O.Ps. ?
ii) Whether the complainant is entitled to get any relief as prayed for ?
4. Perused the enclosures which reflect the purchase of the motor bike, the money receipt which reflects the payment. In view of unchallenged enclosures we are of the view that the complainant is entitled to the relief as prayed for as there is gross deficiency in service on the part of the o.ps.
Both the points are taken up together for consideration.
Hence,
O R D E R E D
That the C. C. Case No. 88 of 2011 ( HDF 88 of 2011 ) be allowed ex parte with costs against all the O.Ps.
The O.Ps. be directed to issue registration number of the motor bike ( TVS Star City 110 ) together with the insurance documents, tax challan, blue book, engine chassis number, free service book document etc. within 30 days from the date of this order.
The complainant is entitled to a compensation to the tune of Rs. 50,000/- for mental agony, pain and mental harassment. He is further entitled to a litigation cost of Rs. 5,000/-. The o.ps. do pay the amount within 30 days from the date of this order failing the amount shall carry interest @ 10% per annum.
The complainant is at liberty to put the decree into execution after expiry of the appeal period.
Supply the copies of the order to the parties, as per rule.
