Final Order / Judgement

Heard Sh. J.P. Kansal, learned counsel for the revisionist, on admission.

This revision petition under Section 17(1)(b) of the Consumer Protection Act, 1986 is directed against the order dated 19.07.2018 passed by the District Forum, Dehradun in consumer complaint No. 202 of 2017.  By the order impugned, the District Forum has taken the written statement filed by the opposite parties on record.

The reasons for taking on record the written statement filed by the opposite parties recorded by the District Forum in the impugned order are self-speaking.  The written statement was taken on record on imposition of costs of Rs. 500/-.

It is well settled that the consumer complaint should be decided on its own merit.

The Hon’ble Apex Court in Civil Appeal Diary          No. 2365 of 2017; Reliance General Insurance Co. Ltd. and another Vs. M/s Mampee Timbers and Hardwares Pvt. Ltd. and another, decided on 10.02.2017, has held that the written statement filed beyond the stipulated time of 45 days’ can be taken on record on payment of costs.

We do not find any infirmity in the impugned order passed by the District Forum.  The revision petition lacks merit and is hereby dismissed in limine.
