PRESENT SRI.K.T.SIDHIQ ; PRESIDENT SMT.P.RAMADEVI : MEMBER SMT.P.P.SHYMALADEVI : MEMBER K.Mohanan, Chettumkuzhi House, Perumbala.PO, Vila.Kalanad, : Complainant Kasaragod. Reliance Web World, Shoba Arcade, N.H.17, : Opposite party Ashwini Nagar, Kasaragod.671121 O R D E R SRI.K.T.SIDHIQ, PRESIDENT Complaint seeks an order for refund of Rs.3300/- which he paid to Opposite party while availing a Land Phone connection with interest, expenses and compensation. According to him eventhough he surrendered the phone no amount is refunded. 2. Notice issued to Opposite party was served on 30-01-2006, on 27-02-2006 Opposite party called absent set exparte. Thereafter the case was posted for the evidence complainant. 3. Due to the vacancy in the post of President and Members the case was not taken up till 17-03-2008. On 17-03-2008 again notice issued to complainant and Opposite party and case posted to 28-04-2008. On 28-04-2008 complainant appeared in compliance with the notice. But Opposite party remained absent. Complainant examined as PW1. Ext.A1 marked. 4. In the complaint the claim of the complainant is Rs.9100/- which includes costs and compensation. We dont think to it is fair to allow the prayer in entirety merely because the opposite party is set exparte. Hence opposite party is directed to refund Rs.3300/-being the amount paid by complainant to opposite party along with cost of Rs.1000/- within one month from the date of receipt of the copy of the order.
