Complainant purchased a sound bar from 1st opposite party. 2nd and 3rd opposite parties are service centers. The case of the complainant is that on 4/8/18 he purchased a sound bar for Rs.19,790/- from 1st opposite party. The product has one year warranty. The sound bar were not working from June 2019. It has been found that woofer and audio were damaged. So he lodged a complaint on 25th June. Even though they assured the service of the technicians nothing has been done. Defective goods were sold by the opposite parties and denied proper after sale service. So he caused a lawyer notice, which yielded no result and hence this complaint.
2. On receiving complaint, notice served properly to the opposite parties. The opposite parties remained absent and set exparte. Thereafter case posted for complainant’s evidence.
3. From the side of the complainant, he filed proof affidavit in tune with complaint. He also produced 7 documents, which are marked as Exts.P1 to P7. Ext.P1 is the invoice No.967810618501188 dated 4/8/18. Ext.P2 is the warranty card, Ext.P3 is the lawyer notice, Ext.P4 series are A/D cards, Ext.P5 is the photo of Harman warranty, Ext.P6 is copy of the screenshot of mobile communication and Ext.P7 is the screenshot of mobile communication raising the complaint.
4. We have gone through the contents of the proof affidavit and perused the documents. The entire transactions, raising of complaint, issuance of lawyer notice and its receipts were proved by the documents marked as Exts.P1 to P7. Since there is no contra evidence available before the Forum and the complainant proved his case, we are inclined to allow this complaint as well.
5. In the result, complaint is allowed and hereby direct the opposite parties to pay Rs.19,790/- (Rupees Nineteen thousand seven hundred and ninety only) to the complainant and further directed to pay Rs.500/- (Rupees Five hundred only) as cost within one month from the date of receipt of copy of this order.
