That the case be and same is allowed ex-parte against the Opposite Party with cost of Rs. 1,000/- only payable by the Opposite Party to the Complainant within one month from the date of this order.
That the Opposite Party is directed to repair the said mobile phone (Panasonic Smart mobile Phone, vide Model No. S/N P 1104140029929, vide IMEI No. 357011050598578) purchased by the Complainant as the said phone will working properly and to hand over the same to the Complainant, within one month from the date of this order.
That in case of non-compliance of the order passed by the Forum, the Opposite Parties is further directed to pay Rs. 100/- per day from the date of this order till its realization, as punitive damages, which shall be deposited by the Opposite Parties to the State Consumer Welfare Fund.
Let copy of this judgment be supplied to the parties free of cost forthwith.
