ORDER

     Heard. The parties have settled the matter. Statement of Sh.Gaurav Bhardwaj, Counsel for OPs and that of Sh.Sapinder Jeet Singh, Counsel for Complainant have been recorded separately, in view of which the present consumer complaint is disposed off being settled. Statement of counsels for the parties recorded today shall form a part of this order and shall be binding on both the parties. It is made clear that in case the amount settled is not paid to the complainant by OPs as agreed upon, this order shall be treated as executable decree and the complainant shall be at liberty to get the same executed by filing an execution.   

     Certified copies of this order be sent to the parties free of cost. The file be consigned.

Statement of Sh.Gaurav Bhardwaj, Counsel for Opposite Parties(OPs).

 

 

The matter has been settled between the parties. As per settlement, the OPs have agreed to refund a sum of Rs.51,687/- (Rs.26,125/- plus Rs.25,562/- paid as premium for two years) and Rs.7,000/- as compensation/litigation costs (totaling Rs.58,687/-) to the complainant towards full and final settlement in this consumer complaint. The said amount shall be paid to the complainant within 45 days from today i.e. 29.01.2020. After payment is refunded to the complainant, the policy in question will stand terminated/cancelled. The complainant has agreed to the same. In the event of failure of payment of this amount, it shall carry on penal interest @ 12% p.a from the date of filing of the present consumer complaint till its realization.
