The Complainant has filed the present complaint under Section 35 of the Consumer protection Act, 2019.

1. The case of the Complainant is that on 18.12.20 one lady namely Manju Arora    M. N.  7535836120 called brother in law of Complainant and told that she belong to BimaLokpal office having employed id no. BM40031MA and stated Complainant is entitled for benefit of Rs. 2,85,000/- on his PNB Met Life Policy for which he has to purchase certain policy from Opposite Party. Thereafter on believing the aforesaid lady Complainant brother in law purchased 6 policies from the Opposite Party and out of which one policy had been purchased in the name of Complainant Badri Lal, dated 28.01.22, policy no. 54056252 premium              Rs. 75,000/- and transaction no. 1113991448871GAMXEMXN2. The accused person namely Manju Arora, Suresh Kumar Mathur, Anurag Vajpayee and Lovely Gupta had cheated Complainant under assurance of high return of benefit amount of aforesaid polices but no benefit had been received by Complainant and his relatives. The Complainant is continuously trying to contact those persons and also branch office for return but of no use. The Complainant has also sent a legal notice to Opposite Party dated 18.04.23 through registered post and same has been received by Opposite Party. Hence, this shows deficiency on the part of Opposite Party. The Complainant has prayed for the premium amount of Rs. 75,000/- with interest @ 24 % p.a. and Rs. 5,00,000/- for mental harassment. He has also prayed for litigation expenses.   
2. The Hon'ble Supreme Court of India in the matter of Civil appeal No. 7289 of 2009 titled as The Chairman & Managing Director, City Union Bank Ltd. & ANR Vs. R. Chandramohan dated 27.03.2023 it is held that:-

“The Proceedings before the Commission being summary in nature, the complaints involving highly disputed questions of facts or the cases involving like fraud or cheating, could not be decided by the Forum/Commission under the said Act.”

 

3. In the present case, Complainant is alleged that he has been cheated by some officials of Opposite Party. As per the law laid by the Hon'ble Supreme Court of India, the present complaint is dismissed with liberty to the Complainant to approach the appropriate Forum / Court in accordance with law.
4. Order announced on 22.09.23.

Copy of this order be given to the Complainant free of cost.
