Written statement on behalf of OP No.1 & 2 filed alongwith evidence in the form of affidavit and copies of documents. An application on behalf of OP No.1 & 2 moved for directing the complainant to place on record the complete policy document. Copy given. Heard. At this stage, the parties have settled the matter. Statement of Sh.Gaurav Bhardwaj, Counsel for OP No.1 & 2 and that of Sh.Babu Ram, Complainant in person alongwith Sh.Devinder Kumar, Counsel for Complainant have been recorded, in view of which the present consumer complaint is disposed off being settled. Statement of the parties recorded today shall form a part of this order and shall be binding on both the parties. It is made clear that in case the amount settled is not paid to the complainant by OP No.1 & 2 as agreed upon, this order shall be treated as executable decree and the complainant shall be at liberty to get the same executed by filing an execution. Certified copies of this order be sent to the parties free of cost. The file be consigned. |

Statement of Sh.Gaurav Bhardwaj, Counsel for Opposite Party(OP) No.1 & 2.
Without admitting the averments made in the complaint, as a goodwill gesture, the matter has been settled. As per settlement, the OP No.1 & 2 have agreed to pay a total sum of Rs.1,25,000/- (Rs.1,10,000/- towards premium and Rs.15,000/- towards costs/compensation) to the complainant as full and final settlement in this consumer complaint. The complainant has agreed to the same. The said amount shall be paid within 30 days from the date of receipt of certified copy of the order. In the event of failure of payment of this amount, it shall carry on penal interest @ 12% p.a from today i.e. 15.05.2019 till its realization. Appropriate order may be passed.
