Today is fixed for filing status report from the Hon’ble SCDRC, WB and further order.

Today the ld. Counsel for the Complainant/Dhr files a petition stating that OPs/Jdrs filed an appeal before the Hon’ble SCDRC, WB against the order passed on 14.08.2014 by this Forum in the C.C. No. 27/2014 and the said appeal was registered as A/1187/2014. Thereafter the said appeal is allowed in favour of the OPs/Jdrs by the Hon’ble SCDRC, WB. Under such circumstances, the complainant/Dhr is not willing to proceed with the present Execution Application further and prays for dismissal of the present Execution Application.

As by filing petition the complainant/Dhr is stating that the appeal filed by the OPs/Jdrs is allowed, the Execution Application has lost its force and it should be dismissed.

Accordingly, it is

that the present Execution Application being No. 61/2014 be and the same is dismissed without any cost.

            Let plain copies of this order be supplied to the parties free of cost as per provisions of law.
