Order No.07, dated: 20.01.2017

Today is fixed for ER of W/A.  Both the contesting parties have filed their haziras.  On scrutiny of the record it appears that the W/A issued against the Jdr. No.2 vide order No.3 dated 21.10.2016 has already been recalled vide order No.5 dated 21.12.2016.  It further appears that on behalf of the jdr. three separate cheques for Rs.2,52,097/-, for Rs.83,421/- and Rs.17,606/- in the name of  the Dhr. being No.488461 dated 17.12.2016, No.488523 dated 19.12.2016 and No.488594 dated 20.12.2016 respectively were filed and the Dhr. received those cheques vide order No.6 dated 6.1.2017 on proper receipt.  Being satisfied that the direction as given in the final order dated 26.5.2016 under execution has been complied with fully.  Today the Ld. Advocate for the Dhr. has admitted that the final order under execution has been fully satisfied.  We carefully perused the materials on record and we are of the opinion that the final order under execution has been fully satisfied.  Hence, it is
