          Appellant and Learned Counsel for the Appellant is absent.  Adv. Rahul Mehta is present on behalf of the Respondent.  He files his ‘Vakalatnama’.  It is taken on the record.

[2]     On 14/6/2010, the appeal was admitted and notices were directed to be issued to the Respondent.  However, the Appellant failed to take necessary steps to issue notice to the Respondent, as could be seen from the endorsement of the registry.  Such steps were not taken till the month of January-2011 by the Appellant and on compliance notice could be sent only on 1/1/2011.  We find that the Appellant and her learned counsel remained absent on previous three dates viz. 9/2/2011, 27/4/2011 and 27/7/2011 and even today.  Thus, we find that the Appellant is perhaps not interested in effectively prosecuting the appeal.  In these circumstances, appeal stands dismissed for default.  No order as to costs.
