Final Order / Judgement

File taken up today on the application moved by learned counsel for OP-respondent. Learned counsel for the OP/respondent i.e. OP-Insurance Company tendered a statement before the Commission that OP/respondent Insurance Company is ready to disburse the amount of Rs.15,890/- (Rupees Fifteen Thousand Eight Hundred Ninety Only) to the complainant being settlement arrived at between them within 30 days from today, failing which the insurance company would be liable to make the interest thereon. On the other hand, learned counsel for the complainant also tendered a statement before the Commission that he is agree to the statement so made by learned counsel for the Op-respondent i.e. insurance company and the matter may be disposed off accordingly.

                        In view of the statements so tendered by both the parties, the present complaint is disposed off with a direction to the OP-Insurance Company to disburse a sum of Rs. 15,890/- (Rupees Fifteen Thousand Eight Hundred Ninety Only) to the complainant within 30 days from today, i.e. upto 27.09.2022 by way of instrument otherwise OP-Insurance Company shall be liable to pay interest at the rate of 12 % per annum for the period of default. In case of failure to honour the abovesaid settlement by OP-Insurance Company, the complainant shall be at liberty to approach this Commission by way of filing execution petition. Both the parties shall remain bound by their respective statements. Copy of this order be supplied to the parties free of costs. File be consigned to the record room after due compliance.
