निशाणी क्रमांक 1 वरील आदेश

In the present application, Recovery Certificate u/s 25 (3) of C. P. A. 1986 has been issued vide detailed order dated 27/09/2018 and accordingly it was reported to the forum by the Ld. Adv. Mr. V. A. Patait that the Executant has received decretal amount of Rs.7,00,000/- but an amount of Rs.50,000/- as per order dated 27/09/2018 was neither deposited in Legal Aid Fund of the forum nor the concerned Collector of Nagpur has send a compliance report.  Therefore the present complaint was adjourned time to time till date.  Today Ld. Adv. Mrs. Suchita Dehadrai has deposited Rs. 50,000/- in Legal Aid Fund of the Forum and copy of receipt is filed on record which is marked Exh. “A” for identification.  Similarly on today’s bord Execution Application No. EA/11/22 which is pending since last 9 years filed by original complainant for recovery of Rs.40,000/- as per final order dated 08/08/2011 is also reported by the original complainant about receipt of the decretal amount of Rs.40,000/- & in  EA/11/22 the accused has complied the order by depositing Rs. 25,000/- in Legal Aid Fund of Forum.  Thus both order dated 08/08/2011 in Original Complaint No. CC/11/27 and order dated 27/09/2018 in the present Execution Application is also satisfied.  Hence Present Execution Application is “Disposed off  settled as complied”. Intimate to concerned Collector of Nagpur about the Compliance of order dated 27/09/2018 by sending Notice of intimation through R.P.A.D, Truck Report be perserved for Records.
